Senate Democrate Rebuttle:

"The stakes are higher and the Senate's advice and consent responsibility is even more important," said Senate Minority Leader Harry Reid, D-Nev. Sen. Edward M. Kennedy, D-Mass., expressed concerns about the court's balance.

I'm not going to lie, I don't think the person who was appointed really matters anymore. It seems to be just a squabble either way. We won't know what is going to happen until it happens. But it could be interesting either way.
